Decision no. 4/2021 (“Decision 4/2021“) establishing the guaranteed minimum gross basic salary per country was published in the Romanian Official Gazette, No. 40, part I on 13 January 2021.
Decision 4/2021 states that the guaranteed minimum gross basic salary per country, provided for in Art. 164 para. (1) of Law no. 53/2003 of The Labour Code, as republished and amended, (the “Labour Code“), is the amount of RON 2,300 in cash per month, excluding bonuses and other allowances, for a normal work schedule of an average of 169,333 hours per month, representing RON 13,583 per hour.
This means that employees will receive a net salary of RON 1,386, which equates to RON 40 more than they received last year.
Additionally, Decision 4/2021 states that for staff in positions for which a higher degree of education is required, this being at least one year’s seniority in higher education, the minimum guaranteed gross basic salary in the country, excluding bonuses and other allowances, shall be set at the amount of RON 2,350 per month, for a normal work schedule of an average of 169,333 hours per month, representing RON 13,878 per hour.
The provisions of the Labour Code regarding sanctions for employers who do not comply with the guaranteed payment of the minimum wage remain the same. Therefore, an employer may be sanctioned by means of a fine ranging from between RON 300 to RON 2,000, in cases of non-compliance.
The rules and obligations provided for by Decision 4/2021 came into force on 13 January 2021 and so, as from this date, all rights and obligations established by law are determined by reference to the level of RON 2,300 as the guaranteed minimum gross basic salary per country.
